I was accused of cruelty to children in the first degree because my daughter and my boyfriends daughter snuck out of the house while I was sleeping. Basically, I failed an in house drug screen at the jail house after I was arrested. The Georgia DFCS took all my rights and gave full custody to my ex fiance. However, the drug screen can not be proven positive. I was taking prescription medication that causes a false positive on an I'm house drug screen. Now the dfcs wants me to take substance abuse classes along with a fairly long list of other things I have to do in order to get custody of my children back. It is a very complicated story. The big issue here however is that the case worker assigned to my case broke HIPAA laws and before having the correct information, contacted the individuals I lived with and told them I failed a drug screen. I already know that in itself is illigal and I need an attorney that is willing to take on the state's DFCS and help me get my name cleared and restore full custody of my children.
Hire an attorney to defend the criminal charges. Hire an attorney to help with defending the Department’s case in juvenile court. You should work your case plan, and cooperate with the Department to get your children returned to your custody. You are not in any position to launch an anti DFCS crusade. Your children are at issue here.
