Long story short, I got a class b misdemeanor for possession of marijuana and a state jail felony for possession of a controlled substance. Both charges were on the same arrest. I received deferred adjudication for both of them. I have already reached the 2 year mark for the misdemeanor. The felony I can't file for another 2 and a half years. (Completed probation in 2017) Should I wait and have both of these filed at the same time when the felony is also eligible?
What are the odds I would be denied non-disclosure? I haven't received any more charges whatsoever. I completed my probation with no issues.
How much does it normally cost to have a lawyer file for you? And how would I go about getting my info taken off of online background checks so apartments and jobs couldn't see that info?
Non-disclosures can get sticky. You cannot file non-disclosures on both cases unless you pled to both cases on the same date. If you did not plead them on the same date, you can only non-disclose the last case you pled to. You should talk to the attorney who represented you originally if possible to make sure you understand what your options are.
