I was pulled over by a State trooper saying that I'm driving at 82mph over 65mph in Garden States Parkway near Paramus. He said that as this is my first offence, he will give me a break by issuing a careless driving ticket instead of speeding ticket.
I explained to him that I might be speeded at 70-72 as I was overtaking another car but he simply refused to listen. Since I do not have any video to proof, thus I tend to see whether a plea bargain to a zero point offence is a possible option.
Appreciate your advice.
The answer is maybe, it really depends on whether the officer wrote in his notes or on the ticket you were going 82 in a 65 a 4 point ticket instead of the 2 point ticket you got. If so the prosecutor may not give you a downgrade seeing you already got one. Its worth a try, but if your license is important to you such as you are a CDL driving or need your license for work, I would definitely hire a lawyer.
Normally you can get a 0 point downgraded charge, usually 39:97.2 unsafe driving, $439 fine first offense. By the way 70 in a 65 is speeding.
The trooper gave you a break from 4 points to 2. You might be able to negotiate for a 0 point ticket. Speak to the prosecutor in court. If you’re really concerned about the points, hire an experienced traffic ticket attorney.
