My girlfriend and I are buying a house. I am not on the loan agreement at all but my name will be on the deed to the house. If we were to separate before the house was paid for what would my legal standing be on ownership of the house?
If your name is on the title to the property, you will have an ownership interest regardless if your name is also on the loan documents or not. That said, I suggest you consult a real estate attorney to discuss and think through the different rights, and also liabilities, you may have by owning the home with her.
Previous counsel is correct. Ownership of a property is determined by the names on the deed to the property itself.
