I was incarcerated in Saint lucie county jail for 4 1/2 months however the cost of incarsaration reflects 6 months at $50/day which totals out to $9000. Although the judge verbally stated that this wasnt right he still proceeded to carry out the sentence. I also cant afford to keep up with the payments which ultimately will eventually result in my license being suspended which will keep me from working because im a landscaper and need my vehicle for work. In my opinion this will simply cut off the nose to spite the face because if i cant work i cant pay fines.
Pursuant to Florida Statute, felons are charged for cost of incarceration in state prison and county jail.
Usually the cost is $ 18,000.00/year, so $ 9,000.00 would be the prorated cost for 6 months of incarceration. From your facts, it appears that your case started in felony court and you were sentenced to 6 months in county jail, and released early due to "gain time" for good behavior.
St Lucie County aggressively attempts collection of these costs, so you are stuck making installment payments to avoid lose of licensure. Paying costs of incarceration for 6 weeks of non-incarceration makes an interesting "test case" for a civil rights/equal protection/undue burden constitutional lawsuit, but it is hard to find legal representation ready to step up pro bono to take on the challenge presented by your question.
