I was arrested out-of-state awhile back. the charges were dropped and I was dismissed. I just got into nursing school. They are requiring me to have a CBC. I'm wondering if my out-of-state arrest will show up because they had me finger printed also.
It really depends on what type of back ground check is run. Some systems only check Louisiana. Others (such as the NCIC system), however, will cover all states, and it will appear.
Nonetheless, if the charges were dismissed, you should be able to retain an attorney in the jurisdiction where the arrest occurred and have that arrest expunged. But, please note that the expungement process can take quite a long time. In Louisiana, once an order of expungement has been signed by the judge, it still can take up to 8 weeks to process.
You should also be mindful that, in connection with such background checks, sometimes your "honesty" in far more important than a past "screw up." In other words, if you fail to report something and the entity running the back ground check finds it, you'll find yourself in big trouble. To this end, I often advise clients to err on the side of disclosure, particularly where they have been "arrested" but not "convicted." But, given the lack of information in your post, I really could not give you any legal advice as to what YOU should do.
Accordingly, I would recommend that you contact an attorney who has an office in the jurisdiction where you were arrested and discuss this matter with him/her in greater detail.
