My fiancée divorced her ex (a family lawyer) and all his military pensions were given to her after his passing. Now that we are getting married he would like to know if by writing a will leaving his pensions to me, will that override the divorce decree? We are in Texas. Please help!
Ps, one more thing, she has remarried.
Generally, no. But there are a number of steps that should be taken to insure distribution of proceeds. If he violated the terms of a decree by trying to beat the decree by a will he could face repercussions and this might even be fraud. I don't know that there is a full and correct answer here, but reviewing the closing divorce document, decree might help an experienced family law attorney better advise you. Tread carefully is my initial reaction.
