i made a hand written agreement with my girlfriend whom i was living with that stated she would pay me back for rent and expenses while she was unemployed we also recorded each other signing that will it hold up in court??
A hand written agreement may be admitted into evidence should you bring suit against your girlfriend. Video evidence needs to be authenticated and is probably not necessary.
It's a myth that only written agreements are enforceable. So are oral agreements. So are agreements "implied in fact" by the parties' conduct.
To prove a breach of contract you need to prove 4 things: 1) the contract 2) its breach 3) no prevention of the breaching parties' performance or their excuse (for example, she was only 16 when she made the contract and lacked "capacity," or she offered to pay and you refused her money and 4) the amount of your damages.
Agreements and their breach are proven in many ways: your oral testimony, testimony of witnesses, copies of checks and bank statements, emails, texts, etc.
Avvo doesn't pay us for these responses, and I'm not your lawyer just because I answer this question or respond to any follow-up comments. If you want to hire me, please contact me. Otherwise, please don't expect a further response. We need an actual written agreement to form an attorney-client relationship. I'm only licensed in CA and you shouldn't rely on this answer, since each state has different laws, each situation is fact specific, and it's impossible to evaluate a legal problem without a comprehensive consultation and review of all the facts and documents at issue.
