This is in Virginia. I was issued a notice forbidding trespassing at a bar for a 3 year duration. I was given the citation in person, and not charged or arrested, however my information was taken down. For the purposes of employer criminal background checks, will this come up in those checks?
Thank you for your time.
You do not say who gave you the notice, a private person/company or law enforcement. In either case, I do not think the notice will appear on our CBC, because it is not a conviction or even a charge - merely written notice of your being "banned" from the property. You can seek a CBC yourself, and then you will know - good luck!
Answers to questions are meant to be general information that an asker can use to further understand a situation and do NOT create an attorney-client relationship. This forum can help non-lawyers learn something they can use if and when they retain a lawyer outside the context of this site.
It should not come up on your background check unless a criminal charge was placed as well. Good luck.
None of my comments on AVVO's website constitute legal advice. It is only food for thought for possible matters to address with a qualified lawyer in your jurisdiction.
