I was given a non traffic citation for public intoxication. I spent the night in jail and was released the following morning. I was not fingerprinted and did not have a mug shot taken. If I plead guilty will this show up on my record and possibly affect future employment? I am a paralegal and this is a definite concern for me. I have to appear in front of the magistrate within 10 days. Any advice is greatly appreciated!!
It really wont have too much effect unless you plan on changing employers soon. You made an error in judgment. Because it is a summary offense, your record can be expunged completely 5 years after the date of the conviction.
You may wish to ask for a hearing. Some counties have pre-adjudication disposition programs similar to ARD for summary offenses. In some cases, the police officer may be willing to withdraw the charges based upon the fact that you have "done your time" Having an experienced criminal defense attorney may be helpful to you. contact one asap.
Since a Summary Offense is not an Indictable Criminal Offense, your "conviction" should have no effect on your current job. If you plan on changing jobs, then a background check could reveal its existence. You do have the right to file a Petition to Expunge it 5 years after the date of conviction, which is discretionary with the court but usually granted.
