I know my first 39:3-40 for driving while DUI suspended isn't criminal and not indictable, but if I can't get out of it and get the jail sentence, even the minimum of the 10-90 day sentence, will I get violated for my probation?
What probation. More information is needed. Normally a MV violation will not violate but it depends what the probation is for and what the conditions are. Since there is mandatory jail time it could result in a write up.
