Most of those demolition & construction contracts indicate that all demo materials will be transported to a landfill.. doesn't that make them trash ?.. the Supreme Court said if I put trash on the easement in front of my house that it's fair game..I was charged with a Class B misdemeanor (theft of property $100 to $750).. meanwhile I'm pretty sure they don't have a scale ticket representing the value of those scrap materials.. so how do they even assign that value.. much less charge me with that crime ?

The material is not legally abandoned until the owner takes it to a designated waste location. Your attorney will receive the State's evidence, including documentation explaining how the valuation was determined. Once your attorney has everything in hand, they will be able to review it with you and advise you of your defenses and possible outcomes.
