Hello, Even though Iam working was not awarded temporary spousal support. Because other party presented false financial statements & false pay stabs. He is not been paying any spousal after two years of separation. Judge indicated that he will be paying for mortgage & has shown less income so he cannot pay. Even though he earned more in past years was not presented & wasn't taken in the account.
What are my options? If they are playing these game early on in the case then I might not get any thing in the end.
If a spouse presented false testimony and exhibits in a pendente lite hearing, the other spouse could obtain the necessary evidence to show the perjury and fraud, present this to the court, and ask the court for attorney's fees and costs, along with damages in lost support resulting from the false evidence. Pendente lite rulings are temporary, and can always be addressed at the final hearing in a divorce case, when permanent relief is awarded.
