answer from them. It has been almost a yr. and still no answer. This is about insurance on the job & since I was an o/o truck driver the policy was Occ / Acc insurance with a Workers' Comp. Override.Now I was in this truck insurance from April of 2005 up till I had my stroke on the job while out on the road doing my job and no one would pay me a dime. But it was a must to have this policy with the override workers' comp. This was to help the truck out while he/ she was out of work. But this never did have to me. I was just left on my own with no help from the insurance. I ask for help from the insurance board of the gov. but no answer as of yet. I was just told they would look in to it. So how long do it take to get an answer back from the intake. I have sent in my proof of my file on job.my job injury was in 2005 of July and from that day to now, nothing have haven. So what I like to know why was this added on to the trucker's insurance . I got a occupation accident insurance policy and it had this added on must have a workers' comp. override police with it. So is I'm covered or not. I got my proof of the insurance. I were to get paid up to 105 week at $500.00 a week, but never got anything.
You need to contact a local attorney that handles both subscriber and non-subscriber cases. If your injury is a stroke, it will be difficult to establish a relationship from your employment to your condition. Workers' Compensation only covers injuries/occupational diseases caused by the job. If your stroke was caused by the job, you will need a doctors report relating the employment to the condition.
Your Occ/Acc insurance may or may not cover your disability. You need to have the policy reviewed.
The best way to figure this out is to talk to a local attorney. Mr. Morris mentioned the issue of "causation" in the workers' comp context, This is the technical term for proving that the work itself caused your stroke. That's very difficult to prove and requires expert medical evidence, or what we generally refer to as a doctor's opinion. An overview of causation is linked below for your reference.
