There may be reasons for some delay in payment after settlement of claims, but your atty should keep you advised as to progress throughout. The length if time from settlement to receipt of check depends on type of claim, possible liens against recovery or even waiting for "finality" of a Decision approving a settlement in workers compensation cases. Ask your atty in writing for explanation of when funds are expected to be disbursed. Atty shoild respond promptly. If not, contact your State Bar Assn for help.
You should ask your lawyer to explain what going on with status of settlement and disbursement in writing if you are concerned. But you also should call and set up an appointment to ask questions. Often times this process is slowed down by the need to negotiate ( or even figure out the amounts of) liens created by health care provides through assignments and authorizations (papers you probably signed in order to get treated), or by the subrogation rights of insurance companies or statutory liens imposed by Medicaid or Medicare.
So, if you check out all of that and can't get an answer that makes sense, sometimes you can reach out to another avvo attorney who can be retained solely for purposes of sorting it out for you.
