If a mom lives with her bf at her bf mother house. The house is a 3/2 in that house lives bf, bf mom, bf sis, bf sis 2 kids plus a mom and her 5 kids. Total of 4 adults and 7 kids. The kids sleep in couches and some in rooms. Is this a court issue or dcf? Mom has kids 50 percent of the time and this living situation has been going on for 3 years.
There is no guideline or rule about family composition or living arrangements that will automatically result in kids being removed from a parent. If the crowded living situation creates an environmental hazard or neglectful circumstances (much more likely under the circumstances you describe than otherwise), or if there's any form of child abuse occurring, then DCF can get involved and shelter a child or more than one child from that parent.
Otherwise, you may be entitled to pursue a modification of child custody action in family court. There must be a substantial change of circumstances since the time the order was entered and the best interest of the child or children is in favor of the change. If this living situation is significantly different from when the 50/50 time sharing was determined, I could definitely see a judge taking a close look at changing things up if the other parent's home is a better environment, especially during school week.
