I take my car for oil change on TOYOTA dealer, I hand them the keys, they took the vehicle to their back lot and they left they keys on the vehicle and window rolled down, some people took the car from there, Toyota report that to police and was saying I have to call my insurance coz they wont take the liabilities, I had not sign anything that said so and also no signs stating that as well, I had personal property and cash in the vehicle. What should I do next , CAN I SUE THEM??
Unless you signed some sort of waiver as part of a mere oil change, giving them the keys created a bailment. Their negligence made the car theft possible; the dealer should be held responsible.
That said, leaving personal property and cash in a car to be serviced was foolish of you.
