We were rear-ended just outside of Disney World. The collision occurred on October 4th 2017.
My wife is dealing with neck ad shoulder pain while I am suffering from left shoulder and upper back pain.
I am sorry to hear about your wife’s injuries. You should immediately speak with an experienced Florida Personal Injury Attorney. You do not have to be present in Florida in order to begin pursuing a claim for damages. I wish you the best of luck and a speedy recovering for your wife.
You should contact a Personal Injury attorney for consultation and representation. Many of us represent clients throughout Florida. However, we are not able to initiate contact with you. Our Avvo profiles contain real client and attorney reviews, prior case examples and all the contact information you need to reach out for a free consultation. Many of us are available to speak with you evenings and on weekends.
My response is my casual opinion and should not be taken or relied upon as legal advice. No communication here is intended to establish an attorney-client relationship.
Any Florida personal injury attorney can assist you. You need to get medical treatment ASAP, though, and then treat consistently and appropriately during your case until your doctor releases you. No treatment means no case.
My answers are not legal advice, and I am not your attorney unless I agree to accept your case and you sign a contract. Avvo is only a general question forum, so you should seek a consultation about your specific legal needs. Please forgi want typographical errors. I'm often replying via via my cellular phone. .
You should retain counsel on contingency fee and make sure you seek or continue to seek medical attention. The courts in Orlando have jurisdiction over your case if a lawsuit needs to be filed.
I am not your attorney and don't know anything about your problem. Do not rely on my response other than as information used to hire an actual attorney.
If you were injured hire a competent personal injury attorney in your area to handle your case. You can use the AVVO find a lawyer tool to help you. You can also consult my Guide for what to do when you are in a car accident in Florida at:

I'm sorry to hear about you and your wife's unpleasant experience here in Florida. I agree with my colleagues that you should consult with a Florida personal injury attorney as soon as possible. Good luck to you.
What you need to do immediately is run, not walk, to the nearest personal injury attorney in your area.
The attorneys in this forum will always try to give you the best information possible given the facts that are outlaid. However, probably 99% of the time, the main theme you will see in any answer is to consult with an attorney, as there is no possible way that any attorney in this forum, based on the limited amount of facts that can be given, can address the issues in full. I’m not saying that all insurance companies are going to try to cheat you.
I handled lawsuits as an insurance adjuster for thirty-three (33) years for three (3) of the larger insurance companies in the U.S. Those companies were always fair and came up with a fair and reasonable settlement range for injury cases. However, what you have to understand is that even the most reasonable insurance carriers are going to offer you the lower end of what they consider a reasonable settlement range and try to get you to take it. The less than reasonable insurance companies will not be as kind as some of the larger companies out there.
Your best bet is to consult with an attorney in your area to obtain a more specific answer and get all of your legal options before deciding what to do. The attorney will also investigate all available coverages to ensure you have the maximum amount of coverages available to you. You can use the "Find a Lawyer" link at the top of this page for names of attorneys in your area. Most offer a free consultation and work on a contingency fee basis, so you won’t have to pay anything up front.
You may find that your claim will be governed by Canadian law, but that remains to be determined based on the individualized facts in your case. You probably will be better off if you can assert Florida law. You should immediately contact a Florida personal injury attorney and give no statements to anyone until you have spoken with counsel.
You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statements to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury attorney in your area as soon as possible so that you can protect your rights. You may also find it helpful to review the Legal Guides I have published on Avvo.com dealing with many of the issues you are now facing. I am very sorry to hear about your situation. Based upon what you have relayed, your situation is somewhat complicated; and so I strongly recommend you talk to and meet with an experienced accident attorney in the central Florida area. I have dealt with Canadian auto,Insurnace policies and they were not so different. Generally, myhe law where the accident occurs is the law that will apply. The attorney should be able to discuss with you all of the potential options you have, so that you can make the best decisions possible. In order to find the best attorney for you, I strongly recommend that you review the AVVO profile, which will have reviews from actual clients of that attorney. You will also have reviews from other attorneys about the attorney you are considering for representation. The AVVO profile will have additional information and links to the attorney's website and email address. This is important because some attorneys will respond to questions sent by email from potential clients after normal business hours and on weekends. I hope this is helpful! The consultation should be free!!!
Other lawyers have already given you plenty of good advice. I just wanted to add that, if you haven't sought treatment yet, you have hurt your case. You need not only a good and experienced personal injury lawyer, but also need medical treatment ASAP after any accident involving injuries. The longer the delay in treatment, the more difficult for us to prove your case. That being said, we routinely handle accident cases involving people who were on vacation. This is very normal for Orlando, as you might imagine, being one of the biggest tourist destinations in the world. I sure hope you both went for treatment immediately after the accident. Last thing: usually with rear-end collisions, the only issue is the extent of your damages. That means how badly you are hurt. We use medical records to prove those damages. Best of luck to you!
This information is for general purposes only, which I have answered without my knowing all of the facts of your case. However, I cannot give reliable advice without knowing the facts of your given case, during a consultation. Therefore my answer does not create an attorney-client relationship between us. You also should not rely on my answer without speaking to me, as one small fact could change my answer.
