We own a manufactured home and lease the space from a mobile home park. A large tree on park land fell on our house during a windstorm. Unfortunately, we have allowed our insurance on the house to lapse due to a variety of financial and personal issues. Who is liable for the damages to our home?
Sorry to hear that you are having to deal with this event. I am sure it is distressing. For starters, you should speak with the owner of the land on which the tree was located. They may have liability insurance that could be a source for paying for repairs. While there is not sufficient information in your question, there may be a basis to make a claim against the property owner. For example, if the property owner failed to properly maintain the tree and it created a dangerous condition on the property, the property owner may be liable for damages. So you should start by speaking with the park owner about their insurance coverage and submit a claim for all the damages caused. Make sure to photograph and or video tape all damage and document all costs, including any costs you incur to eat out or rent replacement housing. You should speak with an attorney in your area and give them all the details as they may very well be able to help you. The sooner you get an attorney involved the more likely they will be able to effectively assist you.
