Neighbor is having a 5 foot tall water cistern installed on property line above our property. If the cistern should fail, water would flood our guest cottage which is lower than their property. Who would be liable for water damages should that happen? They are having it professionally installed.
Yes if the failure causes damage your own insurance should be your first call and they will cover you and go after the proper party or eat the loss. So make sure you keep up with your insurance, perhaps review your policy and make certain all of the contents and structure have replacement costs.
Then if there is a failure you can replace everything and sue the neighbor, his installer , and engineer for your deductible, if necessary and reduce your risk to the deductible.
