I was backing out of an angled one way flow parking space , waved on by a car who stopped to let me out. I have backup cam and the alarms that sound when anything is detected in the rear of my vehicle. I was 90% out when I hear a crunch. I see a Jeep had backed into me. We pulled forward, got out and took pictures, exchanged insurance cards and numbers. We both have Geico. She hit me fully on the passenger side of my vehicle. Her damage is all on her rear bumper. I have dents that match up with her bumper and pictures of all the damage. The Insurance conducted a recorded phone interview with us both separately. They didn’t seem to want the photos I took. They came back and said we are at equal fault. I said, No way! She hit me fully on the side, I clearly had the right of way. I used my backup cam and had a vehicle stop and wave me out. And I look in all my blond spots when I leave. I pulled out first and she backed into me a few seconds later. Do I stand a chance of getting this changed to her fault? Also, she told me she just got her Jeep 4 days prior, so she clearly want used to driving her new vehicle.
Sorry to hear about the accident. It sounds like there may be comparative fault with the other driver bearing most of the responsibility. Seek out an attorney licensed in the state where the accident took place.
Most attorneys will require an upfront retainer fee to handle a claim that is solely property damage. If you were actually injured and actually sought medical treatment immediately, you may find a personal injury attorney willing to take the case. Hopefully you got the name and telephone number of the witness who stopped to let you out.
