When it comes to a class 5 suspension, are driving privileges granted by the court who imposed the suspension, or can they be petitioned for in the court of record where the driver has residence? With 12 point suspensions and non-compliance suspensions, or any other suspension imposed by the BMV, it is court of residence (where the person lives, not where the offenses occurred; see 4510.021(B)). What about class 5 suspensions?
If the suspension is imposed by the court, then THAT court is the court that grants the privileges. If the suspension is imposed by the BMV then it is the court where you live.
