In New York, there is no need to publish a death notice for creditors. After the issuance of letters to an estate fiduciary, there is a seven month creditor's period. During that time, the estate fiduciary should not distribute funds. He should pay legitimate debts and resist unjustified claims. After the expiration of the period, the fiduciary should act in good faith and pay to or preserve funds for legitimate creditors, but he can distribute excess assets without personal liability. It's an often misunderstood and mis-described standard. There is, however, no publication requirement.
