I need to file for an emergent stay of sheriffs sale the sale is Tuesday and the mortgage company has everything they need for my application for a borrower assistance package I'm just waiting on an answer I want to keep my home I have the papers for the stay all filled out I just need to know where to go I live in Toms River , ocean county
This question was previously asked and answered. Nothing has changed. I previously told you that you cannot just obtain a 1 month statutory adjournment of the Sheriff sale and that you will be "OK". You really need to file an Emergency Chapter 13 Bankruptcy and seek a mortgage loan modification through the Bankruptcy Court's mortgage modification program. I have had a very high rate of success for my clients this way.

You may have gotten very lucky. All courts are closed today due to the snowstorm . Please check with the Ocean County Sheriff to confirm that your sale has been rescheduled. You can request, and the Ocean County Sheriff has the discretion to grant you 2 two week adjournments of the Sale. There may be a $28 fee for each adjournment. I strongly suggest that you hire experienced counsel. You may well need a Bankruptcy if the State law options are exhausted and you still have not heard from your mortgage company about borrower assistance.
