My husband is military. We were married in North Carolina, that's where he's stationed. He owns property that we bought in our marriage in Oklahoma. He files taxes in Oklahoma and claims that as his state of residence. I have lived in Kansas with our 2 children for 6months. He's currently deployed. Where do I file for divorce? Oklahoma is telling me it has to be Kansas because the kids have been here 6months. Kansas is saying they can divorce me, but can't do anything about child support or property division/order of support.
You need to file in Kansas because that is where you and your children have lived for the last 60 days. You should hire a KS attorney to help. In Wellington, I recommend Shannon Kelly. Her office is directly north of the Courthouse if I remember correctly in a house converted to an office.

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.
