My ex husband filed an ex parte and retained temporary residential custody of our 8 yr old daughter while I was in a hospital for mental health reasons in March of 2017. I agreed to a permanent order for him to have primary residential custody with me having open ended visitation. I stated that I wanted to switch it back after I had become financially independent and not wanting her to be displaced during the school year. At the time of his filing of the ex parte I had already filed contempt motions on child support and alimony arrears as well as a few other contempt issues from orders not being followed from our divorce decree in November 2015 He owes over 19K in arrears the dept of child support has money on hold from his taxes. We have agreed upon the arrears with a mediator yet I have been paying him $300 a month support payments for the past year. I filed a motion to change the court order and parenting plan in June of 2018 and have had several status conferences but nothing seems to be decided. He had agreed to giving me primary residential as long as I agreed not to ask for child support. I need help knowing what to do next.
