I am being sued in the state of virginia, henrico county and need to file the above mentioned form with the court soon. I do not have counsel and want to meet this deadline. I have received this form from the plaintiff's attorney and he is requesting I return the form signed. Does my signature on his form meet the judges request for pre-trial scheduling or do i need to file also?Rules of the Supreme Court of Virginia, Rule 1:18(A) states "In any civil case the parties, by counsel of record, may agree and submit fo approval and entry by the court a pretrial scheduling order". By my signing of the order prepared by plaintiffs attorney, agreeing to the scheduling, satisfy this order request pro se?
Yes, if this order is a "joint" one, then your signature means that it's from you as well as the plaintiff's lawyer.
Avvo doesn't pay us for these responses, and I'm not your lawyer just because I answer this question or respond to any follow-up comments. If you want to hire me, please contact me. Otherwise, please don't expect a further response. We need an actual written agreement to form an attorney-client relationship. I'm only licensed in CA and you shouldn't rely on this answer, since each state has different laws, each situation is fact specific, and it's impossible to evaluate a legal problem without a comprehensive consultation and review of all the facts and documents at issue.
