My discovery has listed a video and pictures but yet there is no said video or said pictures, I thought it was my right to see the said evidence that the state has against a person! I was told I don’t have that right only if the state is planning on showing it in court and that Only if it can prove my innocence, well don’t you think if I can see the said evidence, I would be able to determine if it can prove my innocence or not?
The state has to show you what they intend to use in their case in chief and anything that tends to show your innocence. They do not have to show you everything and let you decide. Your lawyer can make a motion to compel disclosure if appropriate.
