My man and I argue this all of the time because I do NOT think it is legal to do this but he is prescribed xanax and thinks him snorting 1 of the 2 he is prescribed PER DAY in legal in MA. Am I in the wrong here? Please & thank you!
(Yes we already know it is not advised even it legal but that is not what I am asking)
Keep in mind that it is the POSSESSION or SALE of controlled substances that is illegal. Technically their use itself is not illegal. As a result, if he has a prescription for Xanax, he is not doing anything illegal no matter what he does with it himself. That being said, if his doctor finds out about his abuse of this medication, he is likely to have a note entered into his medical record that he is simply "seeking medication" and will likely lose that prescription.

Interesting question but no, it is not a crime to take a drug contrary to the terms of the prescription but only to possess the drug without a prescription. Another interesting issue arises if one possesses a drug well after the prescription was issued.
