I have been incarcerated for over a year now and have not heard anything from the court or a lawyer and I was just wondering what I can do on my end because I feel like I have been forgotten about and I'm not guilty of the crimes I've been charged with
This is a terrible issue. You need the help of an attorney immediately. You should have been released a while ago. Further, your charges should have been dismissed. Here's the law: under the two term rule, you should have been brought to indictment already. Not doing so authorizes immediate release. After a year with no progress, the case should be dismissed from the docket by the clerk. You typically need an attorney for this to file the Motion to Dismiss. You should ask the regional jail for a financial affidavit. You can also find one under "Court Forms" on the WV Supreme Court website. Then forward that completed affidavit to the Court where you are charged asking for a public defender. Or, you or your family can hire an attorney for you. That choice is yours. This is a fairly straightforward process that should be completed relatively quickly. A good attorney could have you out of jail before the end of the week assuming what you have stated above is factually accurate. Depending on the facts, you may also want to consider a lawsuit against the prosecutor's office.
