Is this going to make my dui an even bigger whole to dig out of? Is there any chance I will not have to spend an extended time in jail in WA State?
You need to hire a local lawyer to help you out ASAP. There are driver's license repercussions as well as the potential for jail time and a criminal record. They may well allege that your driving problems and DUI were the result of alcohol and drugs combined. Moreover, they could charge you with possessing drugs without a legal prescription. Hire a lawyer.
Depending on the details of your situation it may add an additional charge to your DUI. If this is your first DUI you are looking at a maximum of 365 days in jail and a $5,000 fine, or a MINIMUM of 1 day in jail and a fine of $865.50 (plus costs and assesments).
The bottom line is that it depends on what you are actually getting charged with, the specific facts of your case, and whether or not the prosecution can prove its case beyond a reasonable doubt. Any criminal charge is a big deal. Many lawyers, myself included, offer a free initial consultation. You should take advantage of a free initial consultation.
