I moved out of an apartment on 10/2/2012. i dont remember owing any money upon moving, however it looks like they filed suit on 10/5/2015. From what I understand, doesn't this debt fall outside of the statue of limitations in Maryland of 3 years? Does the statue of limitations begin the day of the first missed payment (in this case it would be either 9/01/2012 or 10/02/2012 because the amount insinuates that it's a little over a months rent) or does it begin the day the lease ended?
Also, if I reside out of state, is there a way I can have the lawsuit pursued where I live?
The lawsuit can't be transferred out of state. You can hire an attorney in the jurisdiction of the lawsuit who can hopefully minimize your having to return to MD. If your lease is signed under seal the statute of limitations is 12 years. I suggest that you use the Find A Lawyer feature to set up a consultation with local counsel to review the lease and go over your options.
This is a general response that should not be considered legal advice. No attorney-client relationship has been formed. Please speak with an attorney in more detail about your specific situation.
I agree with prior statement of counsel. However, if the lease is not under seal, limitations would run from the date it expired - it does not make a difference when you moved out.
Agreed on all points: it depends if the lease is sealed and unfortunately it is very unlikely you can move the suit to your location.
I suggest you discuss this with a good debtor’s rights attorney in your area. She or he can discuss your options. You can find one through AVVO or your county bar association. Your state bar association website may have a “Find a Lawyer” option on their page.
Depending on the debt you still owe in this matter as well as other debts you owe altogether, you may want to consider filing a bankruptcy to eliminate this debt once and for all.
I wish you the best of luck! I hope you found this answer helpful!
