Hi. Anybody has the "right" to file for dental malpractice. However, whether the claim is meritorious or not and whether or not the claim would be economical to file is a different question. First and foremost, please know that the "statute of limitations" on dental malpractice actions is typically only 1 year from the date of discovery of your injury (of course there are some exceptions). However, in a typical case, this means you need to get your case filed within a year or it will forever be time-barred. Second, there is a procedural hurdle to clear before you can file a dental malpractice action. Specifically, you must retain an expert to author an Affidavit stating that the dentist/oral surgeon's care fell below the acceptable "standard of care". This process could take weeks and therefore, it is advisable that you consult local counsel right away to determine if you have a claim and then move swiftly to protect your interests by filing a suit before the expiration of the limitations period.
