Recently had a custody trial. Judge ordered 50/50 visitation but dad has to pay me child support. That was back in September and supposed to start October. He hasn’t paid anything yet. How long should I wait before hiring an attorney to file a motion to enforce? I know he has the means and is still employed but just hasn’t paid. What Should I expect?
You can file a motion to enforce now. If your ex husband was ordered to pay support but has not paid it, and he has the ability to pay it, a motion to enforce is the proper remedy to get him before the court and get you paid.
Although I am a lawyer, I am not your lawyer. The site is an excellent resource for locating legal counsel, but posting answers to questions does not create an attorney/client relationship.
