I applied for my husband and his 3 sons Resident Card (no lawyer). We did an immigration interview 9/16 in Las Vegas, NV at that time the officer told us my husband had a deportation order for not appearing in court and he could be detained on sight, but stated he would give him 3 months to return on his own or they would go to our residence and detain him. He went back 11/2016. April 2018 he as given the 10 year ban at his interview in El Salvador. We have been married since 1/2008. The children were always in El Salvador and they became LPR's in 7/2017 and are here in Las Vegas, NV with me but my husband remains in El Salvador.
If he had no good reason for missing his removal hearing, he must wait five years, and then he can apply for a waiver for unlawful presence.
