I TRIED TO EXIT A PARKING GARAGE AND THE TICKET READER WOULDN'T TAKE MY TICKET OR CREDIT CARD. I OPENED MY DOOR TO GET CLOSER AND PUT MY LEFT LEG OUT. THE GATE SUDDENLY OPENED AND MY CAR ROLLED FORWARD. A STEEL POLE SLAMMED MY CAR DOOR AGAINST MY LEG CAUSING A HUGE HEMATOMA. THE GATE CRASHED DOWN ON MY WINDSHIELD SMASHING IT BUT MY CAR GOT OUT. I HAVE TO HAVE MY SECOND SURGERY ON MY LEG TO REPAIR THE HEMATOMA WITH DEBRIDEMENT AND A SKIN GRAFT.
I changed this from drunk driving or DWI to personal injury. since I do both types of cases, I do not think you even asked about being drunk at the time or driving while impaired in Massachusetts. However I think you are asking about whether you can have a claim for this series of events? I don't see how your car can roll forward if you were in park or your foot was on the brake. I'm fairly certain that this accident will be on you and not on anybody else. other lawyers might give you different advice.
