My brothers case is in Philadelphia removal proceedings and they want to transfer his case once hes released from perry county prison which hes in serving a sentence for burglary which he is in PCRA and will get his conviction overturned but they want transfer his case to york is that bad and is Philadelphia better for EOIR proceedings He liked the judge in Philadelphia.
I would need more information to be more certain in the answer I am giving but generally speaking the York Immigration Court only hears cases for people that are being held at the Immigration Detention Center at YCP. If you are not detained there then your case would be heard in Philadelphia. It sounds as though your brother may have a detainer from ICE so when he is done with his being held in Perry County Prison he would be moved to the York Immigration Detention Center. If that were to happen then his case would be moved from Philadelphia to York. Whether this is good or not depends on which Judge is assigned to the case in Philadelphia and which Judge would be assigned in York. If your brother does not yet have an immigration attorney he or you should seek the services of one.
