Would you be arrested for the accounts of marijuana since regulation was not followed or would it be a civil penalty with Florida Clean Air Act.
Depending on where you live in Florida, you could be cited, arrested, or issued a Notice to Appear, which is legally the same as an arrest. Under Section 381.986, Florida's medical marijuana statute, "medical use" of medical marijuana does not include use in a public place. Because Florida criminalizes possession, and not use, of non-medical marijuana, there may be a question of whether a medical-marijuana cardholder would be criminally liable. But if a court rules against you, you would be facing criminal liability.
