A friend of mine was arrested for a DUI 2/14/2015 with a BAC of .24. Currently the case is still open, he should be sentenced at his next appearance. However, he was picked up on 4/9/2016 for an AGG DUI, no valid license and leaving the scene, among other charges. This is his second DUI arrest in Illinois, but he also has one DUI in Michigan which was about 10 years ago.
Your friend needs to consult an IL attorney right away. This is serious. In Colorado, for example, if someone is driving without a license and their license was suspended or revoked because of an alcohol related offense they get an automatic 30 days in jail for a first offense (this is just on the driving w/o license due to alc suspension/revocation). Anytime we talk about multiple DUIs and aggravated we are talking about substantial jail time. Take care.
Because number two is not yet a conviction, he may be able to stay out of DOC. He really needs the same expert DUI defense lawyer on all these and that lawyer needs to be able to work with a treater/evaluator.
There is going to be pain but it might not be irredeemable.
The specifics have to be between him and the lawyer. Wouldn't hurt if he were in intensive treatment already.
When you say your friend will be sentenced at his next appearance, is that following a trial and conviction, or in anticipation of a plea agreement? Because that would make a difference in approach.
Wither way, I agree with my colleagues. Your friend's situation is very, very serious (particularly with the second have a leaving the scene charge) but not hopeless. Hopefully he (or she) has a comprehensive, intensive treatment plan in place, and a good lawyer working on both cases.
