I was served papers yesterday for debt owed by Portfolio Recoveries. They did not hand me the papers, they just left it at the gate. I have not taken it off the fence. I am not working and have already filed for disability and am awaiting a hearing. What would be the most likely judgement if I appear in court and can they legally serve you without putting the document in your hands?
You need to start preparing to defend the case.
Accepting cases in Dallas, Denton, Collin and Tarrant Counties. THIS IS GENERAL ADVICE AND DOES NOT REPLACE A PERSONAL CONSULTATION WITH AN ATTORNEY AND DOES NOT ESTABLISH AN ATTORNEY/CLIENT RELATIONSHIP
don't ignore. Even with problematical service, you could have a default judgment entered against you and that is bigger problems....so deal with them.
Looks like you were served by way of substituted service ( which yes they can serve you without putting in your hands) and you need to file an answer within 20 days .
the likely judgment should you not elect to file and answer or appear in Court or negotiate with the petitioner will be what ever you owe ( you did not say) plus attorney's fees.
Providing general answers are meant to help the poster to understand some complex legal concepts and in no way creates an attorney-client relationship.
