My daughter is living with her mother right now and I have every other weekend visitations. My daughter lives with her mom and her grandparents. The house they live in is very dirty and her grandparents smoke and drink all day. Her mother doesn't work and neither do any of the people living there. My daughters grandfather was arrested for drug possession in a bar and was released earlier this month. My daughter is very thin and her mother admitted to me that she only drinks pediasure and that's it! Mind you she's 2! I'm very worried for my daughter. I know it's her mom but I don't think she's happy to be there..she's a 2 year old and she doesn't act like one. She's very quiet and she's always sick!
You have two options: Call CPS for neglectful supervision. File to modify an existing court order or file an original suit if no court order exists, alleging endangering circumstances to the child's physical health or emotional development. You need to consult with family law counsel. You need counsel to represent you to get your evidence and to prove your case.

The advice given here is not and ahould not be taken as a substitute for in-personal consultation with counsel, particularly where legal documents, such as court orders need to be reviewed. I am Board-Certified in Family Law but not in any other areas of practice.
Hire an attorney and file for custody.
