I first process my k1 visa and got approve and went here to the united states. i didnt bring my son because i wanted to see if life here in the us ill be okay. i am already 8 months here in the united states and i wanted to start processing my k2 visa for my son. is it possible that i could bring him here in the us even i am already here?
You say that you have been in the US for 8 months, but did you get married within the 90 days, as you promised you would when your fiance filed for K-1? If not, then you are in a violation of your status. If you married and filed for the adjustment of status (AOS), your USC husband can file the family petition to bring your son here as a resident, so long as he was under 18 when you married.
