my Mom has always raised me from the beginning. My dad never really been there.( they don’t live together) When I was about 5 years old my mom got child support payments for a few months. Then my dad stopped paying and left the US. I’m 17 years old and till this day, my dad still owes her. He owes thousands and thousands of dollars to her and so I want to know if he was to come back to the US, will he be arrested?
My opinion would largely depend on whether your mother knows the location of where you father fled to. At this point, your mother can file a complaint for contempt for failure to pay child support. In order for a hearing to commence, your mother will need to serve your father a copy of the summons and complaint. If you have no idea where your father is, you may be able to perform service by publication. If you know which country (and address) your father lives in, then you would have to research the method of international service for that specific country. Your mother should contact an attorney to assist her through this difficult process. Good luck.
