I am on an L2 visa and have an EAD for my work. My company is applying for my H1 visa. My question is my passport cannot be stampted for visa as I am living in US. So how will be the process for my H1 visa application? Will I have an interview in USA if my petition is approved? If i travel to my home country and reenter US will I have to undergo an interview process while visa stamping? As I am currently holding an L2 visa now since Oct 2014 what will be my H1 visa maximum allowable stay? Will it be 3 initial +3 renewal or less?
You can change status from L2 to H1B while in the US potentially. You won't get a passport stamp, you'll get a notice of approval from USCIS (assuming you are approved). When you leave the US, you'll need to set up an appointment at the local US Embassy/Consulate and get your passport stamped.
