My changes are as follows:
11378 FEL POSS/SALE/TRAN < 1 OZ. 00030000 BAIL H&S
11550 MISD USE/UN INFL CONTR SUBS 00030000 BAIL H&S
This is my first arrest of the changes and I have never had a drug charge before. I know I need a lawyer, I have medical issues and I am married and have kids.
This is a serious matter. Your clean drug record might make you eligible for an alternative sentence if handled correctly. Jail time for the 11378 is a possibility- but again there are other potential options.
The charge of 11378 requires the prosecution to prove you possessed the drugs with the intent to sell. The arresting officer will need to testify that based on the quantity of the drug, the way it was handled and/or packaged and other factors that it was for purposes of sale. The fact that you are also being charged with being under the influence is a factor to show that the drugs were for personal use as opposed to sale. If, ultimately, an attorney can show that it was for personal use, as opposed to possessed for sale, you may be eligible for a drug treatment program and avoid any felony on your record assuming certain conditions are met. Jail can be avoided in both situations anyway as there is a extremely high likelihood that community service would be granted based on the quantity of the drug. You definitely need a lawyer. My office is is Riverside across the street from the courthouse - therefore - I am there often. Kia Feyzjou 310-266-4488
