my b.d. has been on the run and he was arrested yesterday in philadelphia, pa. He was transferred to darby, pa because he has a bench warrant there. He has been on the run for two year. and they are charging him with attempt to sell crack. He is 22 years old and this is the first time he has ever been in trouble with the law. What type of sentence will he receive? is there anyway he would qualify for the A.R.D. program?
If the pwid charge is in philadelphia he has a better chance at a favorable sentence then in Delaware county. You mentioned he has a bench warrant so this cannot be the first time he is in trouble with the law, even if the warrant is for an outstanding traffic citation, which is doubtful bc he has been on the run as you stated.
ARD is very unlikely. What is the detainer for and was the pwid in Philadelphia? More information would be helpful.
It is difficult to answer your question without additional information. A lawyer requires more detailed information before giving an opinion.

I can tell you for sure he will not qualify for the ARD program in Delaware county. The sentence will depend on the weight of the drugs. You or him need to contact an attorney immediately to begin representation . It is very important to have good counsel from the very beginning especially if he pick up another new case in Philly.
