In sept 2014 I was physically injured by a towing and recovery company. I had an attorney who is no longer on the case and not much was done. I have irreversible neck injuries which include herniated disc and I suffer from neck and limb pain daily.
No, it is not better to file your own case. If the first attorney has not done well for you, hire a second one. Right away.

You want an experienced personal injury lawyer. Don't do this yourself. You were seriously injured and this case may be defended aggressively.
You'll be much better served, and more likely to have a better recovery, if you hire a lawyer.
Contact a personal injury lawyer in your area. Most injury lawyers offer free consultations and work on a contingency fee basis. You can use the "find a lawyer" tool on this site to search for lawyers.

Always remember that you control the attorney-client relationship. You may decide to fire and hire another attorney whenever you feel like you need to. In order to establish whether you have a case you need to seek out a personal injury attorney and have a consultation. That attorney will be able to analyze your case to see if you even have one. You need to bring medical records with you that detail your injury. It is also important to know if you had any pre-existing conditions prior to this incident. All important factors for your attorney to consider. I wish you the best and I'm sorry for you injuries.
It is not a good idea to pursue this case without an attorney. If you have serious injuries as stated by you, the last thing you want to do is not have a strong advocate on your side if available to you. That said, do you have proof of the assault and battery -- was an incident report made; a police report done; anyone arrested and convicted; photos taken of the injuries while fresh; any independent witnesses; etc. The last thing you want is to pursue a case based on merely he said, she said.
