I was in recovery down in Orange County California. Upon admission I came in under the influence and signed a lot of paper work agreeing to terms and conditions including automatic bank drafts. This is the process for all patients coming in. I feel as if they took advantage of my condition. What sort of attorney would I seek to help me take care of this matter?
Your intoxication is normally not an excuse to your contracts. You may wish to contact a business litigator, but I suspect the cost of legal services will be high compared to the amount you owe to the medical facility.
The above is general legal and business analysis. It is not "legal advice" but analysis, and different lawyers may analyse this matter differently, especially if there are additional facts not reflected in the question. I am not your attorney until retained by a written retainer agreement signed by both of us. I am only licensed in California. See also avvo.com terms and conditions item 9, incorporated as if it was reprinted here.
For a question like that, you'll have to provide more information. Did they take money out of your account that was not authorized and/or owed? I imagine the bank drafts was for their payment, but some elaboration (don't give names) is necessary to determine what sort of legal issue you may have.
While I am an attorney with over fifteen years of experience, until we sign a retainer agreement, I am not YOUR attorney. My postings are meant for informational purposes only, and DO NOT constitute legal advice, nor do they create an attorney-client relationship between us. As such, the question, my answer, and any comments left to my answer, are not protected by attorney-client privilege. Also, keep in mind that all legal claims have relevant statute of limitations, some of which can be very short. So, if you believe you need to hire an attorney, and need legal advice, seek out legal representation as soon as possible.
