I am the plaintiff and have already been to arbitration with the defendant. The defendant owes me X amount of money that he had borrowed from me, I have a signed promissory note that was written out by the defendant stating that he owes me X amount of money. The arbitrator found the case in my favor. Since then the defendant has requested a trial de novo and it has been granted.
If it was an Ober traitor that I'm not sure why he is a new trial. That said, probably any litigator can help you get this out-of-the-way
Why not kill two birds with one stone and get debt collection counsel involved at this juncture on your behalf.
Your adversary is requesting that a new trial be held, which will be. It is a good time to talk settlement with your adversary- as he/she is likely to lose for a second time. Consult with an attorney with respect to entering into a payment agreement or entering the judgment, if and when the second trial is concluded.
