You can opt out of the class action if you like. Members of a class who are not the lead plaintiff usually only get pennies on the dollar. You should consult with an experienced commercial litigator. You might want to start in Indiana as there may be Federal Diversity Jurisdiction depending upon the amount of damages, I doubt it but it does not hurt to ask counsel. I think your best bet is to find a commercial litigator in PA in the County where the company is located. Keep in mind that your full recoverable damages may only be $12,000 ( ask counsel if this is the case) and if so you have to make a decision whether it is economically worth opting out as you could easily spend in excess of $12,000. 00 to litigate the case and then have a worthless judgment.

If the basis of your lawsuit is the same as the basis of the class action, then I think you should search for a class action lawfirm that also handles "opt out" lawsuits. If the basis of your lawsuit is different, then you should find a commercial litigator who handles contract disputes.

The best thing to do is hire a Pa attorney who practices in or near the city of the lawsuit where it is being litigated. They can advice you and get access to all court fillings to assist you in your suit if you decide to file one.
